Welcome to BacteriaID!

These Terms of Service ("Terms") govern how you, the user ("User"), engage with the BacteriaID web application, together with any related software applications, technology and websites ("BacteriaID" or the "Service"). Please read the Terms carefully before using BacteriaID.

Our Privacy Policy describes the collection and use of personal information. Although it is a separate document from these Terms, we recommend that you read and understand it.

Acceptance of Terms

By accessing or using BacteriaID, you explicitly acknowledge and agree to be bound by these Terms. If you do not consent to these Terms, kindly refrain from using the Service.

Who Are We

In compliance with the provisions of Law 34/2002 of July 11, 2002, on Information Society Services and Electronic Commerce (LSSICE), we inform you that the Service is co-owned and co-operated by Fundación para la Investigación Biomédica del Hospital Gregorio Marañón (FIBHGM) and Universidad Carlos III de Madrid (UC3M).

FIBHGM, registered with VAT number G83195305 under Spanish Law, is a foundation with its principal offices located at C/ Doctor Esquerdo 46, Pabellón de Gobierno (ground floor), 28007 Madrid, Madrid.

UC3M, registered with VAT number Q2818029G under Spanish Law, is a public university with several campuses in the Comunidad de Madrid. For the purpose of these Terms, its offices are located at Av. de la Universidad, 30, 28911 Leganés, Madrid.

Throughout these Terms, the mentioned entities may be referred to as "we," "us," or "our."

Copyright and Intellectual Property

The content, features and functionality provided by BacteriaID and its services, including but not limited to text, graphics, logos, icons, images, audio, video and software, are our intellectual property and are protected by copyright, trademark and other intellectual property laws.

We respect the intellectual property rights of others and expects its users to do the same. If you believe that your work has been copied or used in a way that constitutes copyright or intellectual property infringement, please contact us with the necessary details to address the issue promptly. Users found in violation of these terms may face account suspension or termination.

Use of the Service

Both academic, personal and business use of the Service are free of charge. However, it is expressly prohibited to resell or provide our services to third parties for compensation.

You agree to employ BacteriaID in strict compliance with all applicable laws and regulations within the European Economic Area (EEA). Your conduct while utilizing the Service must adhere to the highest standards of ethical and legal responsibility.

Research Use Only

The content and services on this platform are intended for research purposes only. Any use for diagnostic, therapeutic, or clinical purposes is strictly prohibited. These materials are not validated for clinical use, and users are responsible for complying with applicable laws and regulations. BacteriaID disclaims any liability for misuse, and users accept responsibility for adhering to Research Use Only (RUO) terms.

User Content

Upon uploading samples to BacteriaID, you automatically grant BacteriaID a non-exclusive, royalty-free, global, perpetual, irrevocable license. This license empowers BacteriaID to utilize, reproduce, modify, and adapt such samples with the explicit purpose of refining and improving our AI models.

User Responsibilities

By contributing content, you affirm that you possess the requisite rights to confer the license specified in the "User Content" Section. Additionally, you commit not to upload any content that infringes upon the rights of others, including intellectual property rights, or that is unlawful, offensive, or otherwise inappropriate.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the European Economic Area (EEA). Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts within the EEA.

For the resolution of any conflict that may arise on the use of the Service, the User agrees to submit to the Judges and Courts of Madrid (Spain).

Liability

The Service is provided on an "as is" and "as available" basis, without any warranties, express or implied. We do not assume any liability for the accuracy of the offered predictions, the availability of the Service, or any indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenues under any circumstances.

Modifications to the Service

BacteriaID retains the right to modify or discontinue the Service, either temporarily or permanently, with or without notice. BacteriaID disclaims any liability for such modifications, suspensions, or discontinuations.

Termination

BacteriaID reserves the right to terminate or suspend your access to the Service at any time and for any reason, in compliance with EEA laws, with due regard to notice requirements where applicable. The license granted in the "User Content" Section shall persist even after termination.

Changes to These Terms

We may update these Terms or our Service accordingly from time to time. Any changes will be effective immediately upon posting the updated Terms on our website. Please check back periodically to review any updates.
